Theft scheme over 500
If found guitly of theft over 23,000.00 with no criminal background will the judge consider jail time??

This depends - which county, which judge, which state's attorney and what they are asking for.

$23,000? Yes, I would say a judge will definitely consider jail time. That does not mean he will grant it, but you can bet that the prosecutor will argue strongly for jail time. This is relatively serious. You need someone to present your side, point out any mitigating circumstances to the judge and convince him/her that this was not typical behavior for you.
If you are a student (a good student), have a steady job, or caught up in some one time situation - you may be able to avoid jail time.
