Legal Question in Criminal Law in Maryland
time limit
Is it true the state only has 180 days until the charges have to be dropped. My pre liminary was cont. 2 times on the 3 time the dropped the felony and now I go back to court tomorrow. I want to request a jury trial and my 180 days is up april 14th so does that mean if tehy dont give it to me before that day It gets dismissed?

Re: time limit
The 180 day Hicks rule applies to Circuit Court cases. In district court, a speedy trial dismissal will likely not happen until 1 year if you were prejudiced by the delay, unless less time is considered unreasonable State delay.
