Violation of Probation

My son was put on probation in Sept. and October 2003 for one year. This was for two crimes committed while he was heavily addicted to crack cocaine. These were theft charges of less than $500.00 a misdemeanor. He was going to rehab once aweek for meetings. This obviously wasn't enough because he was still using.He got aVOP for having a dirty urine test in April and then under the influence was charged with 4th degree burglary in May. His Vop hearing was scheduled for June 16,2004. We presumed that this charge was included in the VOP hearing . He got 60 days 30 days for each judge. When he got out he went directly to in house rehab from august to september. he saw the P.O. one more time because his probation ended in the beginning of Oct.

H went to court for this charge in jan. 2005 The P.o. busted him for VOP for the may incident of 2004. Can he do this?
