i would like to know who has the ability to utilize a witness ?
and can this person be a suspect in the case ?

Both the State and a criminal defendant may derive evidence from a witness. A criminal defendant has a right to have the court use its power to bring an uncooperative witness to trial.
A witness could be a suspect in a case and this presents difficulty with representation since a witness cannot be compelled to testify against him/herself.
