The alcohol limit on a DUI charge is your best defense to a conviction in either state. You may likely be convicted of the charges in both states. Your circumstance is not unusual.

Particular counties in Maryland can be onerous, and Pennslyvania takes all traffic charges much more seriously than Maryland. I represent drivers with drinking and driving charges. Maryland will consider your second dui as a second offense. The severity of that depends on which County in Maryland you got your dui. Baltimore County will give little weight. Harford and Cecil, will give much greater weight. You should seek a Maryland Lawyer, me for instance, immediately so that you can get advice on minimizing your Maryland offense. There can only be ONE first offense. It would be illogical otherwise. There is no conceivable way BOTH could be your first. PA has one of the toughest DWI laws in the country; very harsh. I would somehow navigate the system so that PA is my first.Take a chance with a somewhat lenient disposition. Leave MD for your 2d. Where ar you licensed? MD or PA? You have to also consider the consequences of a conviction on your license, this could also influence your strategy. GoodLuck.
