DUI 2nd Offense

For the last 5 years I've taken care of my bipolar wife, 2 children, my 87 yo mother and 91 yo stroke victim father. In August'06 my wife took what little money had and moved leaving the kids and a mountain of medical bills, credit card debt, equity loan, etc. A week later driving from home to my parents, arrested DUI, 2 weeks later after leaving a funeral 2nd DUI. I just received 6 days and 2 years probation for the 2nd offense. I already have an interlock and work restriction.

A month prior to August I had to drop my Med. Ins (no money)and stopped taking my anti anxiety meds, my Meds for depression and sleep aid. None of the judges believe this was a contributing factor in my bad decision to drive. I drink very little, with two

boy( who weren't home at the time) to look after I wouldn't set that kind of example. I live in a very rural area (50 mile round trip to town and work) What can I expect, in jail time for VOP ? Worchester Co, Md

Also will there be any provision for me to at least continue to drive to work or how long the MVA suspension? I will have no way to work, get the kids to the bus stop,or even buy groceries.

Re: DUI 2nd Offense

The VOP really depends on the judge and is difficult to predict. You can request a modified suspension of your license to allow you to drive to work, but you need to request a hearing withing 10 days of receipt of the temporary license, if you had one. The penalty for a 2nd offense is suspension is 90 days. If you refused a breath test, the suspension is 120 days for the first refusal and 1 years for the second.
