DUI/Violation of Probation/Limitations

4 years ago I was arrested and found guilty of DUI and

given a suspended sentence after a 3 year probation

period. There was no injury or damage involved and I

had no priors and nothing since. I did my probation for

a while, but moved to another state and failed to

actually complete the probation. I recently found out

that I have a warrant for my arrest in MD--

1. Is there a statute of limitations on violation of

probation?

2. Am I likely to go to jail if I turn myself in?

3. Will MD require me to leave my current state of

residence and stay in MD?

4. Could I be extradicted to MD if I got pulled over in

State B?

The statute is tolled once the probation violation is filed.

2. Am I likely to go to jail if I turn myself in?

That is up to the Judge who violated your probation. Many times the judge will lift the bench warrent when an attorney enters an appearance.

3. Will MD require me to leave my current state of

residence and stay in MD?

Not unless you are in jail here.

4. Could I be extradicted to MD if I got pulled over in State B?

Yes, but not likely. More than likely you privilege to drive in Maryland has bee suspended and therfore when you check the motor vehicle administration in your home State you will see your license is suspended there also.

You should contact a Maryland attorney immediately as the penalty for the violation would be the jail time the Judge suspended.
