Legal Question in DUI Law in Maryland

Interstate Driver Compact

My family member was recently charged with DWI in the state of New Jersey. We live in the state of Maryland. If found guilty in New Jersey would it affect his driving priviledges in Maryland? If so, will he be able to get a restricted driver's license to communte to and from work only?

Re: Interstate Driver Compact

NJ and MD have what they call reciprocal interstate compacts whereby they report back and forth on each other's drivers. Consequentlly, if found guilty in NJ you can be sure the record will be reported to his home state for MVA to enter the conviction and depending on the nature of the charge convicted, he could earn either 8 or 12 points plus an alcohol conviction. The good part is that MD can't do anything against his license without giving him a notice to appear, like "show cause". He should be very alert for the mail, usually within 30 days after the NJ conviction. THat means he may need legal representation in MD after this is over. Unless the case is dismissed in NJ or he's found no guilty. GOod Luck. Joe Trevino, 301-441-3131.
