Punishments for DWI
I have been charged with the following charges:
Statute TA 21 902-Driving while intox.
Statute TA 21 901.1 (b) -Negligent Driving
Statute TA 16 303 (c)- driving on suspended licence
Statute TA 16 303 (d)- driving on revoked licence

'''' TA 21 801.1 - Driving veh on highway at speed exceeding limit

I refused a breathalizer test. Also I didnt know that the police office was pulling me over because he put his lights on and went past me as I turned into a store and he then came back around and pulled into the parking lot. This is my 3rd DWI charge. The last one I got 2 weeks in jail and 2 years probabtion. My guestion is: What kind of punishments am I looking at for this? Thank you very much.

Driving on suspended license carries 1 year in jail. 3rd DWI can carry two or more years, depending if you first dwi was probation before judgment. Failure to take the breath test is now admissible in Court. Preparation now may minimize your jail time, and may make a plausable argument for no jail.
