Legal Question in Family Law in Maryland
I have a 11mos daughter. Her father only gets her when it's convinent for him or his mother. We have a proposed order that says I have Physical custody and he has visitation rights. He didn't follow the order to begin with. I had to call the police to inform them that he said he wasn't bringing out daughter back. When she came back home to had a rash and diarrhea. I tell her father all the time to watch what he feeds her and buy her the things she need and he doesn't follow nothing I say for the best interest of our child. We we're order to take a dug test and he didn't go to take it. We had to go to parental classes and he fail to go. But he wants joint custody. I want Sole custody of my daughter. I provide for her every needs. What can I do to obtain Sole Custody
1 Answer from Attorneys
You should retain an experienced family law attorney. If finances are an issue, go to a legal clinic in your county, which you can learn about from your county bar association, and consult with an attorney about filing a petition for sole custody. But this will not bar the father from visitation, although you may be able to get a solid court order designed to force him to correct the behavior you described upon risk of being held in contempt of court and possibly losing or restricting his visitation rights. You may qualify for a pro bono (free) or reduced fee attorney to assist you with this.
