1 Year Seperation
I am getting a divorce and I am going to be changing back to my maiden name. Do I need to wait for the end of the year seperation before changing my last name on my social security card and drivers licence? Am I able to keep my husband on my health insurance until the divorce is final, or does he need to be removed once we seperate? Is it a good idea to swith off years claiming our son on our taxes? Regarding your name change, legally you will need a court order, which you can get as part of the divorce. Informally, you can start referring to yourself by your maiden name. Re the health insurance, you'll be unable to cover your husband as of the date of divorce. As far as the tax exemption issue is concerned, generally the custodial parent gets the exemption unless he/she authorizes the other parent to take it in a given year. If you and your husband agree to alternate the exemption year to year, you'll have to complete the appropriate IRS form each year.
