Legal Question in Family Law in Maryland

16 yr old refusing to go with a parent

I am 16 yrs old I do not want to be forced to go to my father's house anymore. What would happen if I refused to go with him anymore? Can they put me or my mother in jail? What should I do?

Your father could file a contempt petition against your mother for violating the visitation order, as she is responsible for compliance. No one is going to jail. I suggest you discuss this or at least write to your father and tell him your feelings, and that you want to see him on your terms and not according to a court schedule. Courts will generally give a lot of weight to the wishes of a 16 year old on this issue, so if your father does go to court, your mother can file a cross-petition for modification of the visitation order, asking the court to relieve her of the responsibility for your visitation and allowing you to decide when to visit with your father.

Your mother may petition the court to amend the previous visitation order based on the material change in circumstance that you are no longer willing to visit with your father. Your reasons for refusal must be sufficiently compelling for a judge to determine that it's in your best interest to amend the previous order.
