My 8 yr old son,who was left by his mother, with her mother for approx 3-4 months wants to move in with me. There is no court ordered custody as it was a voluuntary decision made by both parties early on. He has seen his mother only a handfull of times during this 3-4 month period(maybe 4-5 times). A month and a half ago my son told my wife and I he wanted to move in with us. I contacted his mother and she never really gave a yes or no answer. Now she will not repsond to phone calls or text messages. I have talked to his grandmother and she as agreed she thinks its best he moves in with us. Does his grandmother have any rights pertaining to making that decision for him?

No. But since there is no custody order, there is nothing preventing you from picking up your son from his grandmother. But to secure your rights, you should also file a custody petition in your local circuit court. Speak to an experienced family attorney about this.
