best course of action
Hello.. I have a situation where the father and grandmother took me to court about 4 yrs ago for legel custody of our child. At the time I did not understand the law and think I was treated unfairly. I was told that we would go to mediation and that never happend. I was told to write a letter about my side of the story and I did and the court did not acceot it because I did not ''state'' what they wanted in turn I thought I did. I did not have money for a lawyer so custody was given to the father and his mom which I still find strange. Well the child has been with me since kindergarden. I take the child to all dr. appts, I make all of the decisions.. ie summer plans, school plans etc. I want to move to a better community so that the child will go to better schools etc... I know that I have to go and petition the court for a chnage but I'm not sure what to petition for? Sole physical custody w/ joint legel? Please advise also will it be better to seek a lawyer? The grandmother is a hand full and thinks the child is hers.

If the child is residing with you now and has been for a significant a period of time, filing for sole physical custody would appear to be appropriate. Regarding legal custody, if you are making the major decisions and communications with the father and grandmother are not conducive to the best interest of the child, you may want to file for sole legal custody. In any event, I would strongly recommend hiring an attorney to represent you.
