Legal Question in Family Law in Maryland

adoption

In 1999, I lost my parental rights in court for my 3 youngest children. They were adopted by their foster parents. Now my children are 14 and 15 years of age and are not happy with their adoptive parents. They have indicated that they want to live with me. What legal recourse do I have to get custody of them?

Re: adoption

You would have to file a petition for custody in the court where you lost your rights, or in the court where the children now live. You should retain an experienced family attorney to represent you if you are serious about this. You will need a well thought out custody plan and a compelling reason why, after 9 years you are more fit to have custody than you were then. You will also need to demonstrate why the foster parents are no longer fit to maintain custody. Your childen can express themselves to the judge, but aren't quite old enough to control their destiny. And if the judge senses that their unhappiness with the foster parents is because they are perceived as being too strict, without more you face an uphill battle.
