Adoption of spouses child

I am getting married this June. I have a daughter from a previous relationship. She will be 3 in June. Her biological fathers name is on her birth certificate but he has never had any contact with her. I have tried to find him so my fiance can adopt her but I cannot find him. It has been 3 years that I have been searching. My fiance has been the only father my daughter has known. How can he adopt her? Can it be based on the biological father abandoning her?

The court will allow your husband-to-be to adopt your child, provided you satisfy the court rules regarding notification of the child's father. Since you don't know his present whereabouts, you will have to file a court action and "notify" him of it by publishing a notice of the suit in a newspaper. A hearing will then be held on the fitness of your fiance as a father.
