Adultery and Alienation of Affection
I live in the District of Columbia but the adultery took place in the state of Maryland. My husband commited adultery on me and from this affair a child was born(alledgedly) He left me to live with this woman in Hyattsville, MD. He took me off of his health insurance knowing I am permanently disabled with neck and back problems from a fall and subsequent surgery and will need medical care for a very long time. I get SSI every month of $338. My question is twofold. Can I get alimony from him and can I sue her for Alienation of Affections in the state of Maryland?

Since he is now living in Maryland and since you
are saying that the cause of action arose here,
jurisdiction would appear to be appropriate in this
state. So let me deal with your questions in
reverse order.
The question about alienation of affection is the
easier one to answer. It's not a cause of action in
this state. I had a client who wanted to sue on
those grounds so I did a fair amount of research on
the subject a while back. The fact is, there was a
time when a lawyer could be sanctioned for brining
such a cause to court.
As for alimony, you can sue for that and you might
actually get it. Alimony is rehabilitative in Maryland
so you are not entitled indefinitely to it as a matter of law.
But you would probably be entitled to it in this
case, and you could very likely be reinstated on his
insurance policy.
You are not dealing with simple issues so I would
strongly suggest you seek an attorney for this case.
