Alimony, follow up

If a spouse pays alimony the entire year but the agreement isn't filed until that Fall, can he declare the alimony he actually paid a year's worth or just that alimony paid after the agreement was filed?

Alimony can be deducted from the taxable income of the person paying it, whether or not it is the result of a written agreement or court order, unless the agreement states specifically that the payments shall be non-deductible by the payer and non-taxable to the recipient pursuant to the Internal Revenue Code, section 71. Payments made by one spouse to the other before a divorce is final may not be deductible.
