What grounds are needed for or to recive alimony from a spouce?

There are several bases that may be received by a judge. Amoung them are the relationship between the parties, previous and prospective earning capacity, whether the claiming spouse was in process of acquiring an ability to enhance earning capacity, respective age differences, and other bases.

Where a child is involved there may be other consideration.

There are a number of factors involved, but the most important are that the spouse seeking alimony must show the inability to support themselves, and that the other spouse has the financial wherewithal to support him/her while still maintaining his/her own ability to support himself/herself and dependents. Generally there has to be a significant disparity in the respective incomes. If either spouse isn't earning to their capability, based on experience, skills, work history, etc., the court will base its determination on what that spouse should be earning if employed to his/her full capacity.
