Legal Question in Family Law in Maryland
Alimony Guidelines
Based on a Property, Custody & Separation Agreement, the divorce has been filed but because of disparate incomes, a hearing to consider alimony is set.
At separation, I made $72K/yr. My exwife made $7K part time, she later took full-time employment that pays her approximately $23K/yr. Since the separation (3 yrs ago) my income has risen to $101K/yr. I pay $800/mo in child support for one 17 yr old child.
In our separation agreement, I paid her temporary support for 2 years...that has ended. Because the agreement made no statement about permanent support, the court will review her claim.
What can I expect?

Re: Alimony Guidelines
There are no guidelines for alimony as there are for child support. The court can consider a number of factors to decide if, and how much, alimony should be paid. Your incomes are certainly disparate enough to result in an award of alimony, but the judge can consider not just income but assets, health costs, the standard of living you established during the marriage, the duration of the marriage, the cause of the end of the marriage, and a number of other financial considerations. I assume you have a lawyer who should be familiar with the Maryland law regarding alimony and prepared to present evidence in court which will further your interests in this matter.
