Legal Question in Family Law in Maryland

There are not enough assets

My stbx dissipated almost all the marital assets. Even if I get the judgement against him, how do I collect? His income is 5200. a month and his home and vehicles are paid for. So besides the child support (1 child) how much of that income can the courts garnish?

And basically am I looking at getting his income for several yrs instead of lump sum pymnts?

Re: There are not enough assets

Once you have a judgment, you can attach his property, including real estate and his bank account if you can locate it. You can garnishee his paycheck up to 25% of his net pay. So if his take home pay is, for example, $3500/mo, you could require his employer to deduct $875 and send it directly to you. If you are fortunate enough to locate a bank account with a substantial amount in it, you can attach the entire account up to what he owes you and get a court order requiring the bank to pay that amount over to you.
