Do I need an attorney present?
Does an attorney need to be present for a child support hearing? Both parties have been informed, through their attorneys, of the amount of support deemed by the Child Support Office. One party has yet to be served the official summons, and has been evasive in responding to attempts at contact by the opposing party's legal counsel, thus creating additional fees.

An attorney is not mandatory for any proceedings in Maryland between individuals (family law or otherwise). However, it may be beneficial to have one in a child support case if you wish to have child support awarded above or below the Maryland Child Support Guidelines. An attorney can argue mitigating factors (e.g., supporting other children in a current marriage, ill-health, etc. to reduce payments - or arguing extraordinary expenses to increase payments). There may also be voluntary impoverishment issues in such cases.
