Legal Question in Family Law in Maryland

i have a baby about 2 years old i am planning to break up with my husband next month. I havent told him yet .I left my baby at my mom's place in india last year . I am afraid during divorce can he file an obligation against that in court for authority of baby that he disallowed that ( sending baby to live temporarily with my mother in INDIA ) .do i need to get him sign a paper in advance in order to prevent such thing ?

Please advice me i even need a advocate for my case !

Your husband could seek custody as part of divorce proceedings. And he certainly could argue that your leaving the child in India was an indication of your inability to care for the child, depending on the surrounding facts. You need to retain an experienced family attorney who can advise you and possibly put together a separation agreement that resolves all issues regarding custody, support, visitation and property issues before filing for the divorce. If you income qualify, you may be entitled to a reduced fee attorney through your county bar association.
