Your question omits too many facts to be answerable. Does anyone beside the mother have legal custody now? Is the mother also seeking custody, in which case she would have priority over the grandparents. If there has never been a court hearing regarding custody, the child would be under the care of her mother until a court issues an order to the contrary.
