back alimony

My settlement states that I am to receive 450.00 in alimony a month no time limit, settlemnt was done in Virginia, I now live in Florida and ex lives in Maryland. For many years he has only been sending 200.00 a month with one year of no payment due to loss of job. This was never legaly changed. He owes me appox. $40,000. I have just found out that he is gravely ill and will not be able to work, Can I put a lein on his home to obtain money owed?

Re: back alimony

You will first have to go back to the court that issued the order to pay alimony and get a judgment for the alimony that is owed. Once you get that, you will have to file the judgment in MD, since that is where your ex lives. You can then execute the judgment against any property owned by your ex in his name. But note--if he remarried after your divorce and his current wife's name is on the deed, you won't be able to execute the judgment against it.
