Back Child Support 2
Yesterday I asked a question about back child support, which was not included in the final ruling last week. Your answer was ''The court only has the power to award support from the day a petition is filed, which hopefully is what it did.'' I filed in May 07 and I didnt start receiving support until Feb 08 because my ex delayed the case so long. I dont believe arrearages were included for the previous 9 months. Can I just send a letter and ask them to recalculate before the judge signs off on the final order. The case on friday was heard by a master. His reccomendations will be submitted to a judge for final approval (I think that is what happens)

No. You should have specifically requested that support accrue from May '07 at the hearing. Unfortunately, often the masters don't like to impose retro support because it immediately puts the parent paying support in an arrearage status. At this point, you need to file exceptions to the masters recommmendations within 10 days of the date they are issued to enable the reviewing judge to consider making the award retroactive.
