Bank accounts and separation

I am separated from my spouse of 13 yrs and anticipate a divorce in the future. I plan on moving out of the family home in one month. We own property jointly but have no minor children. I have recently opened bank accounts in my name alone and wonder what the law is concerning my spouse's right to access the accounts. I am also concerned about division of debt and what part I will be liable for at the time of legal separation.

Your spouse cannot access a bank account to which he/she is not a signatory. As to division of debt, any joint debts are the responsibility of both parties, and creditors may look to either or both to collect. This is why it is always best to try and come to an agreement with your spouse regarding division of property and debts before you proceed to a divorce. A family law attorney can be of great assistance in helping you reach an agreement which protects your interest and complies with legal requirements.
