Legal Question in Family Law in Maryland

My boyfriend and I had a child in 2008, we have joint custody of her with primary physical being mine. My daughter and i have always lived with my parents and him with his. He has been in jail since 1/2011 and convicted of several felony charges. My parents now are attempting to sell our house and move to maryland. Can i up and move to maryland and file for full custody there or are there some steps that i need to take in va before i leave there?

You will have to establish residency in MD for 6 months, and then you will be able to file in MD for full custody. Your boyfriend will continue to have visitation rights. Unless the VA custody order prevents it, you do not need his permission to move, but if you are on good terms I suggest you discuss it with him so he understands you're not trying to take the child away from him.
