Legal Question in Family Law in Maryland

My boyfriend and I want to know if its possible for us to take custody of his son from my boyfriends parents? Heres our situaton we live in a 2 bedroom condo with a 3year old and a 4month old. We both work full time jobs and are pretty stable.

If the parents have legal (court-ordered) custody or guardianship, your boyfriend will have to file a petition to have custody transferred to him. Otherwise, he is entitled to custody as the bio father. The mother would also have equal custodial rights, and if she is in the picture, your boyfriend should go to court anyway with a custody petition to protect his rights.
