Legal Question in Family Law in Maryland

Hi!

I'm doing this for my brother. We need a legal advice from someone familiar with the laws in the U.S.

My sister in law lives in Maryland and she was able to bring their youngest daughter there back in March. Now she sent a document for my brother to sign about a custody of their child. She is saying that she needs to have a custody paper signed by my brother so she could send their child to school there.

My question is, is it really required in the schools of Maryland that the mother gains full custody of the child before she is admitted to school? My niece was born in the Philippines, if that would help.

I just need an answer to that and I would really appreciate any advice that you can give me.

If your sister in law has established legal status and residency in MD, she does not need full custody status in order to enroll her daughter in school. She may be trying to get your brother to sign away custody rights. I suggest you have him send her a letter authorizing her enroll the daughter in the school, but not waiving any custody rights. Even though the child is living with her mother, the parents could have joint legal custody under MD law.
