name change or adoption with non-biological father's name on birth certificate

my son is 8 yrs old and wants to change his last name to my husband's last name. we have also discussed step-parent adoption. the person named on the birth cert. was found not to be the biological father four years ago with no further contact with my son. the i.d. of the true bio. father is unknown. please help?

Your husband can file a petition for adoption in the circuit court in your county. He will be required to publish a notice in the newspaper to give anyone an opportunity to oppose it if they see fit to do so. With your consent, the court should readily approve this without an investigation. He can include a name change request with the petition.

Your husband can still adopt your child. He will have to post a notice in a local newspaper to give notice to all that an adoption will take place. You shouldn't have difficulty after 8 years.
