Changing Child Custody and Visitation
My son has an ex-girlfriend that has obtained a protective order and used it to her benefit with false accusations which led to false arrest and incarceration of my son. Although his job was obolished and he is presently unemployed, he tries to keep up with his child support payments and he has no criminal record. She has also lied to the court to gain full custody of their child. Since then she has been found guilty of one count of assault and one count of destruction of property. She has been put on probation(twice)and has served 1 day in jail. She has not complied with the court ordered visitations and now she is lying about moving to another state. There is finally an investigation into her failure to comply with the order and her claim to have moved. There is a visitation hearing coming up and I am afraid that she will play the victim again and sway the court. She is totally unreasonable and my son is getting very fustrated. He has already given up custody because he thought this would calm the mother down. He has talked about giving up his parental rights. My question is what steps can we take to turn this situation around if the court does not see the real picture? We have already missed two years of her(the child)life.

If having this child in your lives is important enough to you, you should hire a family law attorney to represent your son at this hearing. He or she will know what evidence is needed to protect your son's rights.
