Can I be charged for fees not actually incurred?

My husband is buying me out of our home. He wants to charge me for fees that he is not incurring such as real estate commissions and closing costs. His arguement is that he would have to pay these fees if he would put the house on the market, so he should therefore get to deduct them from what I am entitled to. Is he correct?

If the transaction is part of a written agreement, such fees would have to be identified and agreed to in the agreement. In the absence of an agreement, I would object to such fees since they are not costs that he is incurring and the amounts are speculative and not actually incurred.
