Child Name Change

I am currently going through a divorce. If I remarry, can I change my son's name to my new husband's name, without my new husband adopting him. I do not think his father would ever agree to letting someone adopt him; but to make it easier on my son, I would like all of us to have the same last name. Thank you so much for your help.

This process begins with the filing of a petition, which is then published in a local newspaper. The purpose of publication is to give anyone who might object to the request the opportunity to be heard. You may also have to send notice of the petition directly to your ex as well. If he objects, you will probably not be able to accomplish this, unless there is a compelling reason to change the child's name to that of his stepfather.

You didn't indicate what the status of custody is in the divorce proceeding. If your soon-to-be-ex is granted legal custody, your chances of getting the child's name changed are even less.
