Child custody and adoption

My 7 yr old son who--name removed--bio father has been incarserated for 1st degree homicide all of my sons life has threatened to take my son from me once he--name removed--released and has made an indirect threat on my life. I've been married for 3yrs and wanted to know if I would succeed at stepparent adoption? and what I should do to protect myself and family.

You need to petition the court to terminate his parental rights. Believe it or not it isn't an open and shut case. Some courts still will not terminate the rights of the parent even though the person is in jail for murder. Still, you do have a good chance!
