child custody

my ex-girlfriend has custody of our 2-year old son. She is going to jail for 3 weekends for a DUI. What rights do I have to take my son for those weekends if custody is already established? I have visitation every other weekend and she wants her mother to watch him while she is in there.

On the weekends you have regularly scheduled visitation, you of course will have your son. On the other weekends, you don't have an automatic right, and it wouldn't be practical to go to court over this. Perhaps you could negotiate a trade with her whereby you get him for those three weekends and then she gets him for the next 3.
