Child Custody

I would like to file for sole custody of my child. The father has moved and has not given me his new address or telephone number can the court award me custody based on the fact I have no knowledge of his whereabouts?

There is that possibility where the court finds granting sole custody is in the best interest of the child. You will have to petition the court and the court will give notice of a hearing.

You may be required by the court to post a copy of your custody petition in a local newspaper, in an effort to give the father notice of your plans and an opportunity to be heard. You will also have to send the petition to his last known address in case his mail is being forwarded. But as long as the court is satisfied that you have made a sincere effort to notify him, his disappearance cannot stop the court from granting you custody.
