child custody and moving

Hello...

I have joint legal custody of my 8 1/2 year old son with my ex-wife. I have primary physical custody with her having visitation rights. She pays no child support to me for his care. My question is I am going to be married to a woman who lives in the UK and I wanted to know if I can move my son from the U.S. to the UK and what process I have to follow. I live in Maryland.

Check your judgment of absolute divorce and/or separation agreement. There may be a requirement that you notify your ex of any pending move. The typical notice is 45 days. Such a move may trigger her to file a motion to modify custody if she objects. The move would automatically constitute a material change in circumstances. She would then have to show that a change in custody would be in your son's best interest.
