Child custody

Hi i have a question. i was married to my husband for 2 yrs and just recently left. we have a 2 yr old daughter who lives with me and he only sees every other weekend. we have not gone through child custody yet because we are waiting for our hearing. now he has many of times when he has her refuse to give her back. i was wondering if i chosse not to let him see her anymore until we go to court is there anyway he can come to my parents house where we both reside and take her away from me?? please let me know i am confused.

Until a judge determines who should have custody, either parent has a right to have the child. Of course, if he forcibly removes the child, that will not stand him in good stead with the court. By the same token, if you refuse to allow him to see her, that won't make you look too good, unless he's abusive. I suggest you try and set down a time schedule until the case goes to court, and if he violates it (for example, she's supposed to be home by 6 o'clock and he doesn't show up until 9), then you'd be justified in restricting him in the future.
