Child Custody

What are my rights as far as

access to my son's medical,

educational or any special needs information if I am not the custodial parent.

If your ex-spouse has full legal custody, you will need his/her consent in order to get medical care providers or school officials to release this information to you. If you can't get it, and believe the custodial parent is not fulfilling his/her duties with respect to health care or education, you may have grounds for seeking a court order to obtain access to the records. If you file a court action, you could subpoena the records as part of the discovery process. If you contemplate a court proceeding, you would be well advised to get legal assistance.
