My sons mother and I were never married. She was awarded sole custody 7 yrs ago as I was in active addiction. Things have changed and I have been sober for 6 yrs and would like joint legal custody only. Mother says no chance as I refused to marry her after child was born. I have relationship with child and have never missed a child support payment. Can I not seek joint legal custody of this child. Is there a law that says you have to marry someone even though you you are in an alcoholic comma? Mother claims desertion but I have cancelled checks to prove other wise.

Your nonmarriage does not disqualify you from seeking joint legal custody. Joint legal is more the rule than the exception these days. If the mother refuses to agree, file a court petition, but I strongly suggest you engage an experienced family attorney to represent you in this matter.
