If the father's goal is having access to the child (visitation), he doesn't need to prove the mother unfit. He does need to demonstrate what access is in the child's best interest. Assuming there is nothing that renders the father unfit, or visitation contrary to the child's best interest, the father's burden is pretty low. He should speak to competent domestic relations counsel quickly, though, since the longer he goes without seeing the child, the more difficult it will be to unify the two of them.
