Child Custody/Legal Custody

The father is asking for legal custody only. The parents were never married and the father lives with his mother. The mother has her own residence and earns more than he does. They can't agree on anything, and he is only asking for legal custody to be a pain in the butt. Do most judges frown on giving legal custody to a parent if they were never married?

In today's modern world, the Court does not frown on giving legal custody to a never married parent.
