Legal Question in Family Law in Maryland

child support arrears

my husband has become disabled and it was agreed upon in a child support court hearing that he would pay 50.00 a month out of his disability check for arrears. the child also receives the child benefit amount each month. we have just opened a joint savings and checking account and i am wondering if child support can and if it is legal for them to withdrawal money from the joint account for paying the arrears. since the court order was made he has not missed any payments, all have been paid according to the agreement made by my husband and his ex-wife. thank you for a quick response in advance.

Re: child support arrears

When you refer to them, I assume you mean the Office of Child Support Enforcement. If that is the case, I would suggest calling them to set it up.

Re: child support arrears

They shouldn't be doing this without your authorization. You might consider transferring these funds to a separate account in your name only.
