child support
I became disabled in 6/2006. I had made child support payments up until that time, including $50/mo for arrears. I contacted the child support office to let them know that I had cancer and would not be working while in treatment and of course, if I died. The child support rep. has always been extreamly rude to me for 16 years. They wanted quite a lot of paperwork about my condition at that time, and I was unable to get it to them. (I was in fourth stage of cancer and terribly sick from Chemo) The ex wife called them constantly telling them I was working under table and not paying. I did get rid of the cancer but am completely and permanantly disabled from the chemo. They took me to court for contempt hearing. When I told them I had no money to give them, the judge charged me with contempt. I went to the court date with the two forms from two different doctors, one saying that I was Physically disabled, and another saying that I was mentally disabled, permanantly... The child supp. Rep took my papers to copy and then said she was going to reschedule the hearing on the same day that I had for a modification, (that I applied for after the last court date) I had to cancel the modification, a lawyer said it wasn't worth the trouble???

If you are receiving social security or disability benefits due to your condition, that counts as income in determining your support obligation. It may be that the amount you are now required to pay is within the guidelines for whatever income you're receiving. If not, you can reschedule a modification hearing.
