Legal Question in Family Law in Maryland
Child Support Enforcement
I have 100% custody of my 2 children, non-cust is in Military, granted divorce 7 years ago in AL, child support was to be paid contingent on sale of marital home, took 6 years to sell home which i did not live in with my children. home sold to ex and his current wife, my name no longer on deed or mortgage, trying to enforce child support, non-cust does pay 50% of order refuses to pay full amount! i am living in MD with my children have done so for 4 years, non-cust owns a home in VA where he lives and also the home in AL - what steps can i take to enforce and possibly increase the amount of child support and in which should i do this. several attempts were made over the years but the sale of home contingency always blocked the way,

Re: Child Support Enforcement
You can initate a support enforcement action in VA under the Uniform Interstate Family Support Act by registering the AL support order there. Then you file a court action asking the VA court located in the county where your ex lives to enter a judgment against him and an order withholding the amount due from his military paycheck to be sent directly to you. You could also try filing in MD since it's more convenient, but you may not be able to pursue it if he raises jurisdictional issues. The procedure is somewhat complicated, and you should seek the assistance of either the Office of Child Support Enforcement (in Prince George's County, it's located in Temple Hills) or an experienced family attorney to assist you.
