Child Support and medical bills

I pay my ex wife 630.00 per month in child support and 400.00 in spousal support. I also supply medical insurance for my daughter. I am receiving bills from dr. and dentist in the amounts that my ins doesnt pay. Shouldnt my ex pay these remaining balances ? Or at least half?

Re: Child Support and medical bills

The answer depends on how the amount of child support was determined. Child support is supposed to include a basic component based on the parents' incomes, plus additional amounts for any daycare expenses and unreimbursed medical expenses. If your support was ordered by a court, all of the above is theoretically included and your ex should pay the rest. If it was by an agreement, a well-drafted agreement would have spelled out whether your payment was to cover these expenses or whether they were to be additional, and if so, how divided. If that was never discussed, it's still subject to negotiation, and she should at least pay half.
