Legal Question in Family Law in Maryland
Child Support
I pay my Ex-Wife $500 a month C.S. I now live in the same school zone and she stays at my house 3-4 days a week. Can I now request that we have joint legal custody and I not pay child support any longer?
Thank You

Re: Child Support
The issue is not how many days the child is with you, but the number of overnight stays. If your child support was computer with the other parent having sole custody and now the child is staying with you more than 35% of the time (128 nights/year or more), then you are likely overpaying support and can move to modify the amount. We can explain more and file papers to start the process if you wish to proceed. You can get more information at www.marylandfamilylawyers.com. Thank you.
Re: Child Support
Is there any arrearage of child support owed? If the child is staying with you more than as was agreed and/or judically decreed then this may change the amount of support. You should speak with an attorney.
