i have a step son that is out of control, he has been dismissed from school for not going, also has a low grade point average of .025. He is constanly running away from home and does not like to be discipline, he is using drugs and alcohol. His father has custody of him, but do not do anything to him for his behavior, his father also drinks and smoke. What can I do to get this child on the right track, in addition what can I do to the father legally wise

Your wife can petition in court for custody of the child, but if he's 16 and resistant to such a change, it will be difficult. The court is supposed to always act in the best interest of the child. Short of that, you could contact child social services in the county and ask them to conduct an investigation, possibly leading to neglected child charges against the father.
