childs name change

My sons mother (we were never married) is trying to change my sons name to that of her new husband. I have had a relationship with this child and paid child support all his life. Her new husband was just arrested for Dwi in the middle of all of this and he does not have a full time job. She is claiming I gave up my parental rights when I did not marry her when the child was born. I vacated the relationship before we knew she was pregnant. Is this something she can do?

Re: childs name change

She is dead wrong about your parental rights. If she attempts to change the child's name, she must notify you of the legal proceeding and you would have a right to object if you wish to do so. Even if the court allows the name change, your parental rights will remain intact.
